Whether your client is a Lawful Permanent Resident (LPR or Green Card Holder), Refugee, Temporary Visa Holder (student visa, work visa, etc.),  Deferred Action Recipient (DACA, DAPA), or an Undocumented Immigrant, which includes those in Temporary Protected Status (TPS) and those with expired visas, may affect the immigration consequences your client may face for a particular conviction. The length of time your client has been in her current immigration status and how long she has been present in the United States may also affect the immigration consequences your client may face for a particular conviction, such as your client’s eligibility to apply for discretionary relief from removal.
